    This proposal would remove the county residency requirement in Arizona Rule of Civil Procedure 73 and clarifies in Rule 74 that arbitration hearings are to be conducted using video conferencing technology. This petition is being filed at the request of the Superior Court Presiding Judges, as there are not enough attorneys residing in rural counties to be able to appoint arbitrators. Expedited consideration is requested to allow for consideration on the December rules agenda to allow any amendments adopted by the Court to be effective January 1, 2027.

    Would amend Rule 73 of the Rules of Civil Procedure to (among other things) remove the requirement that arbitrators must be residents of the county in which they are appointed and to amend Rule 74 of the same rules to require arbitration hearings to be conducted using video-conferencing technology.

    Comments due no later than October 1, 2026, and any reply due no later than October 15, 2026.
