    Filed: January 10, 2025

    Would amend Rules 42 (ER 8.5), 60, 64, and 65 of the Rules of the Supreme Court of Arizona to augment sanctions available to discipline attorneys who are not admitted to the State Bar but are authorized to practice law in Arizona.

    Comments must be submitted by no later than Thursday, May 1, 2025, and any reply by a petitioner must be submitted no later than Monday, June 2, 2025.

    I wholeheartedly support Petition R-25-0018 to amend the Rules to authorize the full scope of discipline against out of state attorneys who commit misconduct. Adoption of this Petition will amend the Rules in a manner that will uphold the integrity of the legal profession.

    I support this rule change for many reasons. It has become increasingly common for lawyers to use the courts as a partisan tool rather than for the Rule of Law it was intended. Often for this purpose out of state attorneys orchestrate nationwide attacks on fundamental principles such as elections, citizenship, equality etc. We have seen identical pleadings filed in state after state by said attorneys. Often these out of state attorneys remain hidden behind the curtain, but other times they are signers, co-signers, or amicus on the cases. Whatever they are, they are utilizing Arizona courts and should have to abide by Arizona rules. It is not enough to simply refer a violation to their home state, Arizona has a right to uphold the ethics of practice in our own courts and should do so.
