Would amend Arizona Rule of Civil Procedure 25 to add a section providing that an action does not abate if a person dies while representing in that action another or others unable to represent themselves and that successor representatives may be appointed for deceased representatives.

    Filed: January 12, 2026

Would add a new subpart to ARCAP 25 providing that an action does not abate  if a person (such as trustee or conservator) dies while representing who is unable to represent himself or herself (such as a minor or incompetent adult).

Comments must be submitted by no later than Friday, May 1, 2026, and any reply by a petitioner must be submitted no later than Monday, June 1, 2026.
