    Another petition on IFLTs – R-22-007– is pending before this Court. Before the Court takes final action, the COFC believes the Court should have the benefit of additional input form the pubic, bench, and bar as to an opt-out model. This petition is for Arizona to adopt an informal family law trial (IFLT) program that would allow each county to adopt either an opt-in or opt-out model.

    The Committee on Family Court met on December 5, 2024. A motion to support the filing of this rule petition passed unanimously.

    Would amend Rule 77 and adopt a new Rule 77.1 of the Arizona Rules of Family Law Procedure to adopt an informal family trial program and allow each county to adopt either an opt-in or opt-out model. The adoption of this program would increase access to justice and improve efficiency in family law matters.

    Would amend Rule 77 and adopt new Rules 77.1 and 77.2 of the Rules of Family Law Procedure to adopt an informal family trial program and allow each count to adopt either an opt-in or opt-out model.

    Comments must be submitted by no later than Thursday, May 1, 2025, and any reply by a petitioner must be submitted no later than Monday, June 2, 2025.

    Would amend Rules 22 and 77 of the Rules of Family Law Procedure to move Rule 22 into Rule 77 and to direct the trial court to conduct the direct examinations of self-represented parties.

    The deadline for submitting a comment on this petition, as amended, is extended from May 1, 2025 to May 23, 2025, and the deadline for the Committee to submit a reply is extended from June 2, 2025 to June 13, 2025.

    At its May 15, 2025, meeting, the Committee on Family Court (COFC) reviewed the status of the Petition, as well as the Comment filed by the Arizona Commission on Access to Justice. During the discussion, one member raised a concern about the lack of a deadline for a party to request a different procedure than the court’s direct examination of a self-represented party in proposed Rule 77(d)(2), Arizona Rules of Family Law Procedure. COFC discussed the concern and voted unanimously to propose the additional three words indicated in red in the attached Reply.
