    Would amend the Superior Court Rules of Appellate Procedure—Criminal to restyle them by using clearer language, avoiding long sentences and ambiguous terms, and using consistent formatting conventions and terminology.

    Petitioners believe the changes proposed by the Directors of the Maricopa County Indigent Defense Agencies significantly alter the appellate rights of criminal defendants, and in some cases are inconsistent with the criminal rules of procedure. In addition, they shift the management of lower court appeal cases from the trial court to the Superior Court and thus any changes would significantly alter the staffing of lower court appeals as well and require more administrative oversight. Finally, the proposed changes make the rules of appeal from lower courts significantly different from civil appellate rights of same. If the proposals are to be considered, further discussion and an appointment of a Task Force to include all stakeholders seems appropriate to determine the feasibility and merit of the proposed revisions to the SCRAP-Criminal, as well as whether the proposed changes serve the interests of justice.
