    The Committee on Family Court (“COFC”) respectfully requests that the Court amend Rules 14, 45, and 45.1 and to adopt Rule 45.2 of the Arizona Rules of Family Law Procedure. The adoption of Rule 45.2 would extend the summary consent decree process to unmarried parents who have proceedings under Title 25 to establish maternity or paternity, legal decision-making, parenting time, and child support.

    Would adopt a new Rule 45.2 of the Rules of Family Law Procedure and amend Rules 14, 45, and 45.1 of the same rules to, among other things, extend the summary consent decree process to unmarried parents.

    Comments must be submitted by no later than Friday, May 1, 2026, and any reply by a petitioner must be submitted no later than Monday, June 1, 2026.

    I support the proposed rule changes and addition of Rule 45.2 to address maternity/paternity and other establishment proceedings.

    I would change the proposed revision to Rule 45.1(d)(4) on page 5 to reflect the case will continue as a petition "for dissolution, legal separation, or annulment" not as "to establish paternity or maternity and/or a petition to establish legal decision-making, parenting time, and child support" as that would be under Rule 45.2(d)(4).
