    In present form, these rules require that upon filing for certain post-decree proceedings, the court must issue an Order to Appear that the petitioning party would then have to serve upon the responding party along with all of the other filed documents. Under this new proposal, the superior court in each County would have the option of issuing an Order to Appear or notice of hearing either before or after service of process is effectuated.

    Would amend Rules 91(h) and 92(c) of the Rules of Family Law Procedure to give a family law court the option of issuing an order to appear or a notice of hearing either before or after service of process.

    Comments must be submitted no later than Monday, May 1, 2023.
    Any reply by a petitioner must be submitted no later than Thursday, June 1, 2023.

    Comments due no later than October 1, 2025, and any reply due no later than October 15, 2025.

    The Family Court Improvement Committee met on March 2, 2023. A motion encouraging further research and stakeholder discussion regarding the amendments proposed to Rules 91(n) and 92(c) passed unanimously.

    By Referral Letter, this Court referred the matter to the Committee on Family Court (“COFC”), f.k.a. Family Court Improvement Committee, for further research and stakeholder discussion. COFC has reviewed the Petition and obtained stakeholder input. At its May 15, 2025, meeting, the COFC, voted unanimously to support an alternative proposal set forth in the attached comment.
